Ricardo Molina, the expert audio examiner hired by President Michel Temer's counsel, said the recording of his conversation with business tycoon Joesley Batista turned in to the Federal Prosecution Service (MPF) as part of Batista's plea bargaining deal was “useless as evidence.” In a press conference late on Monday afternoon (May 22), he said the recording produced by Batista was “full of gaps”.

Molina said the tape was a very low quality recording and the flow of the audio content was not continuous, which means it was impossible to say whether it had been clipped or not. “I can't tell whether it's been cut or not, and that's not least for a simple reason—for the most part, you can't hear what the president was saying.” In his opinion, the recording cannot be considered authentic. “It's poor and it should beexcluded. I can't guarantee it hasn't been manipulated.”

Molina also criticized the prosecutors' decision to admit the recording into the investigation without having it analyzed by Federal Police experts. “They concluded the conversation was 'audible, with a logical flow'. Over half of what the president said was unintelligible. How can a conversation have a logical flow when you can't make out what one of the speakers says?” he contended.
