Senate approves right of reply rule

The Senate approved a bill sponsored by Senator Roberto Requião that regulates the right of reply of individuals or organizations that feel offended by any reports, press statements, or news stories circulated by all media outlets.

The regulation governs all published content deemed to have attacked, “albeit by misguidance, the honor, privacy, reputation, standing, name, brand, or public perception” of the subjects concerned, excluding user comments on the outlet's web page.

According to the proposal, the reply may be published or aired on the same venue, weekday, and time the attack took place. Any personal attack claims should be filed within 60 days of the “dissemination of the allegedly offending content.”

The senators restored the original draft, which entitled the offended party to seek the opportunity to reply or personally clarify the information in the case of television or radio, including by recording their reply on video or audio, or even by sitting at a news anchor desk to read out their reply.

As of the Senate approval Wednesday (Oct. 4), the bill is now pending presidential sanction.
