From basic brick-built areas to large locations with car parks, water parks, and a long beachstrip with tables, chairs and umbrellas, stalls and kiosks on Praia do Futuro beach in Fortaleza have been at the center of a rekindled controversy over use of public beach area.

With its beaches and food, Fortaleza, the capital city of the Brazilian state of Ceará, is one of the most popular Brazilian destinations among tourists from other states and countries.

Both as leisure spots and beach amenities, the stalls and kiosks Praia do Futuro are an attraction for local residents and Brazilian or foreign tourists alike. According to Praia do Futuro's Business Association, there are 60 merchants operating in the area. “The stalls provide a welcome overall sense of safety. They make you feel safe because they are bustling with people,” says Fátima Queiroz, the association's chairwoman.

Because they are located on a place that is legally regarded as a beach area—and as such, a public space—the stalls and kiosks on Praia do Futuro may give way to a different scene. This is because of a lawsuit filed in 2005 that has been heard by an appellate court, which ruled non-compliant business places should be removed.

A survey conducted by the Brazilian Environmental Institute (IBAMA) back then found 153 places along seven kilometers of beach strip, of which 43 were found not to comply with regulations for the area. According to Federal Prosecutor Alessander Sales, the other stalls and kiosks have permission to remain there granted by the Federal Properties Management Secretariat (SPU).
