Brazil: rectification of trans and transvestite names in documents

A term of technical cooperation signed between the Brazilian Bar Association - São Paulo (OAB - SP) and the city hall of São Paulo, on the morning of Wednesday (1), will help trans people to rectify for free their name and gender in documents and certificates. The initiative will be carried out through the programa Respeito Tem Nome [program Respect Has a Name].

There are 90 volunteer lawyers registered at OAB SP who will work on the project together with the Sexual and Gender Diversity Commission of the Section, providing legal assistance in checking documents, issuing certificates and following up on cases. The Respect has a Name program aims to help 160 people throughout 2023. Besides guaranteeing the right to rectification, trans people can request the process without the need for psychological and psychiatric reports or sexual reassignment surgery.

The process of name and gender rectification for transgender people before all RCPN notaries in Brazil is regulated by Provision 73, of the National Council of Justice (CNJ), published on June 28, 2018. The provision meets the right of the dignity of the human person and the right to personality; of equality; to honor; to gender identity or gender expression without discrimination, enshrined by the Federal Constitution and other international treaties to which Brazil is a signatory, such as the Pact of San Jose da Costa Rica and the Inter-American Convention on Human Rights.
