Injunction puts review of impeachment petitions on hold
Supreme Court Justice Teori Zavascki granted an injunction Tuesday (Oct. 13) to suspend the review of the impeachment petitions filed against President Dilma Rousseff with the Chamber of Deputies. The guidelines for the impeachment proceedings had been established by the house speaker, Eduardo Cunha.
The injunction was sought by Deputy Wadih Damous (of the ruling Workers' Party) on Friday (9), and by Deputy Rubens Pereira Jr.. They claimed that Cunha had said the proceedings would be carried out in accordance with the rules of the Chamber of Deputies, but argued that there is a law, Act 1.079/1950, that regulates impeachment proceedings.
The procedural guidance set by Eduardo Cunha was read on the House floor in the end of September, when the house speaker presented a 18-page document saying that the role of prosecuting or trying the President of the Republic for accountability issues has lied with the Senate since the 1988 Constitution, and the Chamber of Deputies is limited to opening or dismissing the case.
