Brazil: extension of the Law that benefits the cultural sector

The Brazilian Federal Supreme Court maintained, by majority vote, the extension of the transfer of funds to support the cultural sector until December 31st this year. The resources are provided for the Paulo Gustavo Law.

The decision of the Plenary was taken in a virtual trial held on Thursday (2) and endorsed the injunction that had already been granted by Minister Cármen Lúcia, in December last year. The only dissenting vote was cast by Minister André Mendonça.

Cármen Lúcia heard the action presented by Rede Sustentabilidade against Provisional Measure 1.135/2022, which postponed the Union's aid to the cultural and events sector due to the impacts of the Covid-19 pandemic. The MP was suspended, in November 2022, by the STF, maintaining the mandatory Union transfers to states and municipalities for the cultural sector.

However, in the action, Rede Sustentabilidade argues that the federal government did not transfer resources in time to support the sector in 2022. Thus, the minister of the STF accepted the request to ensure financial support during 2023.
