Council rejects Lula's injunction against prosecutors

The Prosecution Service National Council (CNMP in the original Portuguese) rejected on Friday (Sep. 16) former President Luz Inácio Lula da Silva's request for a preliminary injunction against the actions of prosecutors in the Operation Car Wash task force in the announcement of the charges against him. In the ruling, councilor Valter Schuenquener argues that, before pronouncing a decision, prosecutors should provide whatever clarifications they deem fit in 15 days.

In the motion, filed Thursday (15), Lula's defense attorneys state that federal prosecutors Júlio Carlos Noronha, Roberson Pozzobon, and Deltan Dallagnol “transgressed their functional duties” of their positions during the interview in which they announced the charges against the ex-president.

Lula's lawyers accuse prosecutors of announcing the judgment on Lula's conviction ahead of time, thus violating the communication policy of the Prosecution Office. Also according to Lula's counsel, the rules of the government agency stipulate that charges should not be made public in a way which may represent the anticipated conviction of those involved.

Charges against Lula were filed with federal authorities in connection with the crimes of money laundering, passive corruption, and misrepresentation. His wife, Marisa Letícia da Silva, was also targeted.
